1. ACCEPTANCE OF TERMS

By downloading, installing, accessing, or using this medication management mobile application (the "App"), you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

2. DESCRIPTION OF SERVICE

The App provides medication management services, including but not limited to:

• Medication reminders and scheduling

• Medication tracking and logging

• Lab results recording and storage

• Health data analysis through artificial intelligence chatbot functionality

• Personalized health information and insights

The App is designed to assist with medication adherence and health management but does not replace professional medical advice, diagnosis, or treatment.

3. NOT MEDICAL ADVICE DISCLAIMER

IMPORTANT: The App and its chatbot feature provide general health information and medication reminders only. The information provided:

• Is not intended to be a substitute for professional medical advice, diagnosis, or treatment

• Should not be used for medical emergencies

• Does not create a doctor-patient relationship

• May not be comprehensive or suitable for your specific health condition

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read or received through the App.

In case of a medical emergency in Singapore, call 995 for ambulance services or visit the nearest hospital emergency department immediately.

4. ELIGIBILITY AND AGE REQUIREMENTS

You must be at least 18 years of age to use this App. If you are under 18, you may only use the App under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

5. DATA COLLECTION AND USE

5.1 Data We Collect

The App collects and stores the following types of health-related data:

• Medication names, dosages, schedules, and administration records

• Laboratory test results and related health metrics

• Health symptoms, conditions, and related health information

• User interactions with the App's chatbot feature

• Technical data such as device information, usage patterns, and app performance metrics

5.2 No Personal Identifiers

We do not collect or store traditional personal identifying information (PII) such as:

• Full legal names

• Social Security numbers or national identification numbers

• Street addresses

• Email addresses (except for account authentication, if applicable)

• Phone numbers

• Photographs of faces

• Insurance information

However, the health data you provide may still be identifiable or potentially identifiable based on the combination of health information entered.

5.3 Data De-identification

All health data stored in the App undergoes a de-identification process to remove or obscure any remaining potentially identifying information. De-identified data may include aggregated medication patterns, health trends, and usage statistics that cannot reasonably be linked back to individual users.

5.4 Use of Health Data

Your health data is used for the following purposes:

• To provide medication reminders and management services

• To enable the chatbot to analyze your health information and provide personalized insights

• To improve App functionality and user experience

• To monitor App performance and troubleshoot technical issues

5.5 Use of De-identified Data for Research

By using this App, you acknowledge and consent that de-identified health data may be used for research purposes, including but not limited to:

• Medical and pharmaceutical research studies

• Health outcomes analysis

• Medication adherence pattern studies

• Development of health algorithms and artificial intelligence models

• Academic research and publications

• Population health studies

De-identified data used for research purposes will not contain information that could reasonably identify you individually. Research findings may be published or shared with third-party researchers, but will not include your personal identifying information.

6. DATA SECURITY

We implement reasonable administrative, technical, and physical security measures designed to protect your health data from unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

7. DATA RETENTION

We retain your health data for as long as your account remains active or as necessary to provide you with services. De-identified data may be retained indefinitely for research and analytical purposes. You may request deletion of your data as described in Section 9.

8. THIRD-PARTY SERVICES AND INTEGRATIONS

The App may integrate with or use third-party services, including:

• Cloud storage providers

• Analytics services

• Artificial intelligence and machine learning services

• Research institutions (for de-identified data only)

These third parties may have their own terms and privacy policies. We require third-party service providers to maintain appropriate security measures and use data only for specified purposes.

9. YOUR RIGHTS AND CHOICES

9.1 Access and Correction

You have the right to access and review the health data stored in your App account. You may update or correct inaccurate information at any time through the App interface.

9.2 Data Deletion

You may request deletion of your account and associated health data by contacting us at [your contact email]. Please note that:

• Deletion may take up to 30 days to process completely

• De-identified data already used in research may not be retrievable or deletable

• We may retain certain data as required by law or for legitimate business purposes

9.3 Opt-Out of Research Use

If you wish to opt out of having your de-identified data used for research purposes, you may do so by contacting us. However, data that has already been de-identified and included in research datasets prior to your opt-out request may not be retrievable.

10. USER RESPONSIBILITIES

You agree to:

• Provide accurate and complete health information

• Keep your account credentials secure and confidential

• Use the App only for lawful purposes

• Not attempt to reverse-engineer, decompile, or discover the source code of the App

• Not use the App to transmit malicious code or interfere with its operation

• Verify medication information with your healthcare provider

• Not rely solely on the App for critical health decisions

11. INTELLECTUAL PROPERTY RIGHTS

The App, including its design, features, functionality, chatbot algorithms, and content, is owned by us and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

12. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose

• Warranties that the App will be uninterrupted, error-free, or secure

• Warranties regarding the accuracy, reliability, or completeness of information provided

• Warranties that the chatbot's analysis or recommendations will be accurate or suitable for your needs

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages

• Loss of profits, data, use, or other intangible losses

• Personal injury or health complications arising from use or misuse of the App

• Errors or omissions in medication information or chatbot responses

• Unauthorized access to or alteration of your data

• Any damages resulting from failure to take medication or from medication errors

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO USE THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the App operators, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App

• Your violation of these Terms

• Your violation of any rights of another party

• Inaccurate or incomplete health information you provide

15. MODIFICATIONS TO THE APP AND TERMS

We reserve the right to:

• Modify, suspend, or discontinue the App or any features at any time

• Update these Terms at any time by posting revised Terms with a new "Last Updated" date

Continued use of the App after changes constitutes acceptance of the modified Terms. We will make reasonable efforts to notify you of material changes through the App or other communication methods.

16. TERMINATION

We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms or for any other reason at our sole discretion. Upon termination:

• Your right to use the App will immediately cease

• You must delete the App from your device

• Provisions regarding intellectual property, disclaimers, liability limitations, and indemnification will survive

You may terminate your account at any time by deleting the App and contacting us to request data deletion.

17. GEOGRAPHIC RESTRICTIONS AND GOVERNING LAW

The App is intended for use in Singapore only. The App is restricted to users physically located in Singapore. If you access the App from outside Singapore, you are violating these Terms and do so at your own risk.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions.

18. DISPUTE RESOLUTION

18.1 Informal Resolution

Before filing a claim, you agree to contact us to attempt to resolve the dispute informally by sending written notice to support-begood@dtxaio.io.

18.2 Arbitration Agreement

Any dispute arising from or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (SIAC) in Singapore. The arbitration shall be conducted in English. Each party shall bear its own costs of arbitration unless the arbitrator determines otherwise.

YOU AGREE TO WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTIONS.

18.3 Exceptions

Either party may seek injunctive relief in court for intellectual property infringement or violation of confidentiality obligations.

19. SINGAPORE PERSONAL DATA PROTECTION ACT (PDPA) COMPLIANCE

This App is designed to comply with the Personal Data Protection Act 2012 (PDPA) of Singapore. However, please note:

• We do not collect traditional personal data identifiers as defined under PDPA

• The health data you provide may still be considered personal data under certain circumstances

• You consent to the collection, use, and disclosure of your health data as described in these Terms

• De-identified data used for research purposes has been processed to remove personal identifiers

20. COMPLIANCE WITH SINGAPORE HEALTH DATA REGULATIONS

We comply with applicable Singapore laws and regulations regarding health data, including:

• Personal Data Protection Act 2012 (PDPA)

• Healthcare Services Act and its regulations

• Other applicable Singapore health and data protection regulations

As a Singapore-based service for Singapore users only, your rights and our obligations are governed by Singapore law. If you wish to exercise your rights under PDPA or have concerns about data protection, please contact us at support-begood@dtxaio.io.

21. CHILDREN'S PRIVACY

The App is not intended for children under 13 years of age. In accordance with Singapore's Personal Data Protection Act, we do not knowingly collect health data from children under 13 without parental consent. If we discover we have collected data from a child under 13 without proper parental consent, we will delete it promptly. Parents or guardians who believe their child has provided information to the App should contact us immediately at support-begood@dtxaio.io.

22. EXPORT CONTROLS

You agree not to export or re-export the App or any portion thereof in violation of export control laws and regulations.

23. ENTIRE AGREEMENT AND SEVERABILITY

These Terms constitute the entire agreement between you and us regarding the App and supersede all prior agreements. If any provision is found unenforceable, the remaining provisions will continue in full effect.

24. NO WAIVER

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
